Terms of Service

Welcome to KPATH ARE ("KPATH," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Kpath concerning your access to and use of the KPATH ARE website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree with all of these Terms, you may not use the Service.
The Service is operated from the United States and is intended for users who are at least 18 years old. If you access the Service from outside the U.S., you are responsible for compliance with your local laws.
1. Description of the Service
KPATH ARE is an online study platform that provides AI-generated practice questions, explanations, and study tools for candidates preparing for the Architect Registration Examination (ARE 5.0).
2. Accounts and User Representations
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share, sell, or transfer your account to any other person.
By using the Service, you represent and warrant that: (1) all registration information you submit is true, accurate, current, and complete, and you will keep it up to date; (2) you are at least 18 years old and have the legal capacity to agree to these Terms; (3) you will not access the Service through automated or non-human means (bots, scripts, or otherwise); (4) you will not use the Service for any illegal or unauthorized purpose; and (5) your use of the Service will not violate any applicable law or regulation.
If you provide information that is untrue, inaccurate, or incomplete, we may suspend or terminate your account and refuse current or future use of the Service.
3. Subscriptions, Credits, and Billing
3.1 Plans. The Service offers a free tier and paid subscription plans billed on a recurring monthly basis. Current pricing is displayed on our pricing page and may change with notice as described in Section 3.5.
3.2 Credits. Paid plans include a monthly allocation of credits that are consumed when you use certain features, such as generating or unlocking practice questions. Unless otherwise stated, unused credits do not roll over to the next billing cycle and have no cash value.
3.3 Billing. Payments are processed by Stripe, Inc. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel. You agree to provide current, complete, and accurate billing information and to promptly update it as needed. All payments are in U.S. dollars. Applicable sales tax will be added where required. We reserve the right to correct pricing errors, even if we have already requested or received payment.
3.4 Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that time. We do not provide prorated refunds for partial billing periods.
3.5 Price Changes. We may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
3.6 Refunds. Except where required by law, all payments are non-refundable. If you believe you were charged in error, contact us at support@kpathare.com within 14 days of the charge and we will review your request in good faith.
4. AI-Generated Content
The practice questions, answer explanations, and other study content provided by the Service are generated using artificial intelligence. While we work to ensure quality, AI-generated content may contain errors, inaccuracies, or outdated information. The content does not reproduce actual ARE examination questions and is not represented as such. You are responsible for verifying important information against official sources, including the official ARE 5.0 exam guide and reference materials.
5. No Guarantee of Exam Results
The Service is a study aid only. We make no guarantee, warranty, or representation that use of the Service will result in passing any division of the ARE or achieving any particular score. Exam outcomes depend on many factors outside our control.
6. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make it available. As a user of the Service, you agree not to:
- Systematically retrieve questions, explanations, or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written permission;
- Copy, reproduce, resell, redistribute, publicly post, or commercially exploit content from the Service, including practice questions and explanations;
- Share account access, or circumvent credit limits, rate limits, or other technical restrictions of the Service;
- Engage in any automated use of the system, including bots, scripts, scrapers, spiders, or data mining and extraction tools;
- Decipher, decompile, disassemble, or reverse engineer any software comprising or making up part of the Service, or attempt to extract its underlying prompts, models, or source code;
- Attempt to bypass any measures designed to prevent or restrict access to the Service or any portion of it;
- Circumvent, disable, or interfere with security-related features of the Service;
- Attempt to impersonate another user or person, or use the account of another user;
- Trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive account information such as passwords;
- Upload or transmit viruses, Trojan horses, or other malicious material, or any material that acts as a passive or active information collection or transmission mechanism;
- Interfere with, disrupt, or create an undue burden on the Service or connected networks;
- Use the Service as part of any effort to compete with us, including developing a competing product using our content;
- Use any information obtained from the Service to harass, abuse, or harm another person;
- Use the Service to violate any exam candidate agreement or confidentiality rules, including sharing or soliciting actual exam content;
- Use the Service in a manner inconsistent with any applicable laws or regulations.
We may suspend or terminate accounts that violate these Terms.
7. Intellectual Property
The Service, including its software, design, branding, mascot, question bank, and content, is owned by Kpath and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial exam preparation. All rights not expressly granted are reserved.
"ARE" and "Architect Registration Examination" are trademarks of their respective owner, used on this site for identification purposes only.
8. Feedback and Submissions
Any questions, comments, suggestions, ideas, feedback, or other information about the Service that you provide to us ("Submissions") are non-confidential. By providing Submissions, you grant us the unrestricted right to use, reproduce, and incorporate them into the Service for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You warrant that your Submissions are original to you or that you have the right to submit them.
9. Third-Party Websites and Services
The Service may contain links to third-party websites or rely on third-party services (such as payment processing). We do not monitor or control third-party websites and are not responsible for their content, accuracy, privacy practices, or policies. Links do not imply our endorsement. If you leave the Service to access a third-party website, you do so at your own risk and these Terms no longer govern.
10. Site Management; Modifications and Interruptions
We reserve the right, but have no obligation, to monitor the Service for violations of these Terms and to take appropriate action against violators, including reporting to law enforcement where warranted.
We reserve the right to change, modify, or remove any content or feature of the Service at any time, and to modify or discontinue all or part of the Service, without notice. We cannot guarantee the Service will be available at all times; we may experience hardware, software, or other problems, or need to perform maintenance, resulting in interruptions, delays, or errors. We will not be liable for any loss or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance. Nothing in these Terms obligates us to maintain and support the Service or to supply any corrections or updates.
11. User Data
We maintain certain data that you transmit to the Service for the purpose of managing its performance, as well as data relating to your use of the Service, as described in our Privacy Policy. Although we perform regular routine backups, you are responsible for any data you transmit or that relates to your activity on the Service, and we shall have no liability to you for any loss or corruption of such data.
12. Electronic Communications
Visiting the Service, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and records, and to electronic delivery of notices, policies, and records of transactions.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, suspected fraud or abuse, or as required by law. If we terminate or suspend your account, you may not register a new account under your name, a fake or borrowed name, or the name of any third party. You may stop using the Service and delete your account at any time. Sections 4, 5, 7, 8, and 14 through 19 survive termination.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT AND ASSUME NO LIABILITY FOR (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (2) ANY UNAUTHORIZED ACCESS TO OUR SERVERS OR PERSONAL INFORMATION STORED THEREIN; (3) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; OR (4) ANY BUGS, VIRUSES, OR THE LIKE TRANSMITTED THROUGH THE SERVICE BY ANY THIRD PARTY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KPATH AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
CERTAIN STATE AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
16. Indemnification
You agree to defend, indemnify, and hold us harmless, including our officers, agents, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) your breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including intellectual property rights; or (5) your violation of any applicable law, including exam confidentiality rules. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
17. Dispute Resolution
17.1 Informal Negotiations. To expedite resolution and reduce the cost of any dispute arising out of these Terms or the Service (a "Dispute"), you and we agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating any court proceeding. Informal negotiations commence upon written notice from one party to the other.
17.2 Courts. Any Dispute not resolved through informal negotiation shall be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction of those courts.
17.3 No Class Actions. To the fullest extent permitted by law, any Dispute shall be limited to the dispute between you and us individually, and neither party shall bring a claim as a plaintiff or class member in any purported class or representative proceeding.
18. Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
19. California Users and Residents
If any complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210.
20. Miscellaneous
These Terms and any policies posted on the Service constitute the entire agreement between you and us. Our failure to enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Terms or your use of the Service.
21. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
